is responsible for the processing of your personal data as set out in this Privacy Notice.
02Personal data we collect
For the purposes described in this notice, we may collect the following categories of personal data directly from you, through our website, contact or scheduling forms, WhatsApp, phone calls, or during your consultation:
| Category | Examples |
|---|---|
| Identification data | Full name, age, sex |
| Contact data | Phone number, email, WhatsApp |
| Billing data | Tax information, when an invoice is requested |
| Health data (sensitive) | Reason for visit (including the field of the same name on our contact form), medical history, diagnoses, imaging studies, condition progress |
| Health coverage data | Insurance provider and policy information, when applicable |
Your clinical data is retained as part of your medical record for the minimum period established by NOM-004-SSA3-2012 on clinical records (at least 5 years from your last visit), or for any additional period required by other applicable law.
03Purposes of processing
Primary purposes (necessary for the physician-patient relationship):
- Scheduling, confirming, and following up on medical appointments.
- Providing the corresponding medical care, diagnosis, and treatment.
- Preparing and safeguarding your clinical record in accordance with applicable regulations.
- Contacting you in emergencies related to your care.
- Issuing tax receipts and administrative management of your care.
- Verifying your coverage with insurance providers, when you request it.
Secondary purposes (not essential, but which allow us to provide you a better experience):
- Sending appointment reminders and communications related to your care.
- Satisfaction surveys about the service you received.
- Information about new services or educational health content.
If you do not wish your data to be used for these secondary purposes, you may state so at any time by emailing atencion@ortopedistacdjuarez.com. Declining these purposes will not affect the medical care you receive in any way.
By providing us your personal data — whether through this website, WhatsApp, phone, or in person at the office — you accept the terms of this Privacy Notice. This notice is available both on this website and in physical form at the office, for those who provide their data in person.
04Processing of sensitive data (health)
Please note that, in order to provide you medical care, we will process sensitive personal data related to your health, under Article 3, Section VI, of the LFPDPPP. This data requires a higher level of protection, and it is only processed with your express consent, given verbally, in writing, or through an unambiguous electronic acceptance mechanism (for example, an active checkbox on our forms).
Your health data is used exclusively for diagnostic, treatment, and follow-up purposes, and is safeguarded in accordance with the administrative, technical, and physical security measures required under current data protection and clinical record regulations.
05Personal data of minors
Dr. Ever García treats, among other conditions, fractures in pediatric patients. When the patient is under 18 years of age, the processing of their personal data, including sensitive health data, is always carried out with the express consent of a parent or legal guardian, who is responsible for providing the information and for exercising, on the minor's behalf, any applicable ARCO rights.
Personal data of minors is not collected directly through website forms without the involvement and identification of a parent or legal guardian.
06Data transfers
As a general rule, your personal data is not transferred to third parties without your consent, except for the exceptions set out in Article 36 of the current LFPDPPP (for example, when the transfer is necessary due to a legal relationship or is required by law).
When you have coverage from a Mexican or foreign insurance provider and request that your care be coordinated with that institution, your strictly necessary identification, contact, and clinical data may be shared with the corresponding insurer, solely to verify your coverage and process reimbursement or payment for your services. This transfer is carried out only when you expressly authorize it.
International transfer arising from the use of digital tools: this website uses Google Analytics and Google Maps for analytics and location purposes (see the Cookies section), which means certain browsing data is processed on Google servers located outside Mexico. Similarly, if you contact us via WhatsApp, that communication is managed through Meta/WhatsApp infrastructure, subject to their own privacy policies. We recommend reviewing these providers' privacy notices for further information.
Internal Halthea note: the exact mechanism for coordinating with insurance providers (direct billing vs. an invoice for patient reimbursement) is still pending confirmation with the doctor. This clause is drafted in general terms to cover both scenarios; adjust once a single procedure is defined.
07ARCO rights and how to exercise them
You have the right to Access your personal data, to Rectify it if inaccurate, to Cancel it when you believe it is no longer necessary for any of the purposes described, and to Object to its processing for specific purposes (ARCO rights: Access, Rectification, Cancellation, and Objection).
To exercise any of these rights, or to revoke your consent, you may send a request to atencion@ortopedistacdjuarez.com, indicating:
- Your full name and contact information so we can respond to you.
- A clear description of the right you wish to exercise.
- Any documentation that helps us locate your data.
Your request will be answered within a maximum of 20 business days, as established by the LFPDPPP.
You may also revoke, at any time, any consent you have given for the processing of your data, including sensitive health data, without this affecting any processing already carried out prior to the revocation. To do so, use the same email address listed above.
If you believe your right to personal data protection has been violated, you have the right to contact the Anti-Corruption and Good Governance Secretariat (Secretaría Anticorrupción y Buen Gobierno), the federal authority now responsible for this matter following the dissolution of INAI in 2025.
08How to limit the use of your information
In addition to the above, you may request at any time to stop receiving marketing communications or informational content by emailing atencion@ortopedistacdjuarez.com with the subject line "Unsubscribe from communications."
